This notice applies to protected health information created or maintained by Summit Spine & Wellness in connection with patient care and healthcare operations.

Your Information. Your Rights. Our Responsibilities.

When it comes to your health information, you have certain rights.

You generally have the right to:

Get an Electronic or Paper Copy of Your Medical Record

You may ask to inspect or receive a copy of your medical record and other health information Summit maintains about you, subject to exceptions permitted by law.

Under federal HIPAA requirements, access is generally provided within the time allowed by federal law.

Texas law provides an additional requirement for certain electronic records.

If Summit uses an electronic health-record system that is capable of fulfilling your request, Texas law generally requires us to provide your requested electronic health record no later than the 15th business day after receiving your written request, unless an applicable exception applies or you agree to receive the record in another form.

Reasonable, legally permitted fees may apply to certain record requests.

Your request should include, when applicable:

Call the office if you need the appropriate records-request form or instructions for a secure electronic submission method.

Please do not send sensitive medical information, copies of identification, insurance information, or medical records through ordinary email unless Summit specifically provides a secure method for doing so.

Summit may need to verify your identity before releasing records.

Requests by a personal representative, parent, guardian, attorney, or another third party may require appropriate documentation or authorization.

Ask Us to Correct Your Health Information

If you believe information in your medical record is incorrect or incomplete, you may ask Summit to amend it.

We may deny a request in circumstances allowed by law.

If we deny an amendment request, we will provide the explanation required by applicable law and inform you of any rights you may have to submit a statement concerning the disagreement.

Request Confidential Communications

You may ask us to communicate with you in a particular way or at a particular location.

For example, you may ask us to:

  • Call a particular telephone number
  • Send mail to a different address
  • Use another reasonable communication method
  • Limit information included in voicemail when reasonably possible

We will accommodate reasonable requests as required by law.

Please keep Summit informed of your current contact information and communication preferences.

Ask Us to Limit What We Use or Share

You may ask us not to use or disclose certain health information for treatment, payment, or healthcare operations.

We are not required to agree to every requested restriction.

If we agree, we will follow the restriction except where disclosure is otherwise permitted or required by law, including certain emergency circumstances.

If You Pay in Full Out of Pocket

If you pay for a healthcare service or item completely out of pocket, you may ask us not to disclose information about that service to your health plan for payment or healthcare-operations purposes.

When the applicable legal requirements are satisfied, we will honor that request unless disclosure is otherwise required by law.

Request an Accounting of Certain Disclosures

You may ask for a list, sometimes called an accounting of disclosures, showing certain occasions when Summit disclosed your health information.

Under HIPAA, an accounting generally may cover disclosures made during the six years before your request.

Certain disclosures do not have to be included, such as many disclosures made for:

  • Treatment
  • Payment
  • Healthcare operations
  • Disclosures you specifically authorized
  • Other disclosures excluded by applicable law

We will provide an accounting and charge fees only as permitted by law.

Get a Copy of This Notice

You may ask Summit for a paper copy of this Notice of Privacy Practices at any time.

You may request a paper copy even if you previously received or agreed to receive the notice electronically.

The current notice is also available on the Summit Spine & Wellness website.

Choose Someone to Act for You

If another person has legal authority to act on your behalf, that individual may be able to exercise your privacy rights.

Examples may include:

  • A legal guardian
  • A parent or guardian acting for a minor when permitted by law
  • A person holding appropriate medical power of attorney
  • Another legally authorized personal representative

Summit may verify that the person has appropriate authority before providing access or allowing that person to exercise your rights.

Your Choices About Sharing Health Information

For certain uses and disclosures, you may tell Summit how you want your health information handled.

Depending on the circumstances, you may have a choice regarding whether we share limited information with:

  • Family members
  • Close friends
  • People involved in your care
  • People involved in paying for your care
  • Disaster-relief organizations

If you have a specific preference, tell the Summit team.

If you cannot communicate your preference, we may use professional judgment and applicable law to determine whether limited sharing is appropriate.

Marketing & Sale of Health Information

Summit will not use or disclose your protected health information for marketing purposes when authorization is required by applicable federal or Texas law.

We will also not sell protected health information except as specifically permitted by law.

Texas law provides additional protections concerning use and disclosure of PHI for marketing purposes.

When written authorization is required, Summit will obtain that authorization before using or sharing the information for the applicable purpose.

Electronic Disclosure of Protected Health Information

Summit creates, receives, maintains, and may transmit certain protected health information electronically.

This may occur through systems used for purposes such as:

  • Patient records
  • Appointment scheduling
  • Insurance verification
  • Claims and payment
  • Referrals
  • Diagnostic imaging
  • Care coordination
  • Patient communications
  • Other healthcare operations

Texas law generally requires notice when PHI is subject to electronic disclosure and may require authorization for certain electronic disclosures.

Authorization generally is not required for certain disclosures permitted by law, including qualifying disclosures for:

  • Treatment
  • Payment
  • Healthcare operations
  • Certain insurance functions
  • Other disclosures authorized or required by federal or Texas law

Where a separate authorization is legally required, Summit will obtain appropriate authorization before making the disclosure.

Texas Chiropractic Records Are Confidential

Texas law provides confidentiality protections specifically for communications between chiropractors and their patients and for chiropractic records concerning a patient's identity, diagnosis, evaluation, or treatment.

Summit Spine & Wellness will maintain and disclose chiropractic records only as permitted or required by applicable federal and Texas law.

Nothing in this notice is intended to reduce privacy protections provided under Texas law.

If Texas law provides a greater privacy protection or patient right than HIPAA in a particular circumstance, Summit will follow the applicable requirement.

How We Typically Use or Share Your Health Information

HIPAA and other applicable laws allow healthcare providers to use or disclose PHI for certain purposes without obtaining a separate authorization each time.

Common examples include treatment, payment, and healthcare operations.

Treatment

We may use your health information to provide, coordinate, or manage your healthcare.

We may share relevant information with healthcare professionals involved in your treatment.

For example, Summit may provide appropriate information when coordinating:

  • A referral
  • Diagnostic imaging
  • MRI or CT imaging
  • Specialist evaluation
  • Another healthcare service

Information will be disclosed consistent with applicable privacy requirements.

Payment

We may use or disclose health information to obtain payment for healthcare services.

This may include communicating with:

  • Health insurance plans
  • Claims administrators
  • Auto insurers when applicable
  • Other entities responsible for payment

For example, health information may be submitted with an insurance claim or used to verify available benefits.

Healthcare Operations

We may use or disclose health information as permitted to operate Summit Spine & Wellness and support patient care.

Healthcare operations may include:

  • Practice administration
  • Quality improvement
  • Compliance activities
  • Staff training
  • Billing
  • Recordkeeping
  • Auditing
  • Business planning
  • Patient-service activities
  • Other legally permitted operations

Summit may use vendors or contractors that perform services involving PHI.

When HIPAA requires it, appropriate Business Associate Agreements or other legal safeguards will be used.

Appointment Reminders & Care Communications

We may use your health information to contact you regarding:

  • Appointment reminders
  • Scheduling
  • Follow-up visits
  • Care instructions
  • Administrative matters
  • Insurance or payment matters
  • Other healthcare-related communications permitted by law

You may request reasonable confidential-communication preferences.

Public Health & Safety

We may use or disclose health information for legally authorized public-health or safety purposes.

Examples may include:

  • Preventing or controlling disease
  • Reporting certain conditions
  • Reporting certain injuries
  • Reporting suspected abuse or neglect where permitted or required
  • Reporting adverse events where applicable
  • Responding to a serious and imminent threat to health or safety
  • Other public-health activities authorized by law

Research

We may use or disclose health information for research only when applicable legal requirements and safeguards have been satisfied.

Patient records are not automatically available for research merely because they exist in Summit's records.

Comply With the Law

We may use or disclose health information when required by federal or Texas law.

This may include disclosures to governmental or regulatory agencies responsible for monitoring compliance with healthcare, licensing, or privacy requirements.

Health Oversight

We may disclose health information to appropriate health-oversight agencies for activities authorized by law, including certain:

  • Audits
  • Investigations
  • Inspections
  • Licensing activities
  • Compliance reviews

Workers' Compensation

We may use or disclose health information as permitted or required for workers' compensation or similar legally established programs.

Law Enforcement & Government Requests

We may disclose health information to law enforcement or government entities only when permitted or required by applicable law.

Examples may include certain:

  • Court orders
  • Warrants
  • Administrative requests
  • Statutory reporting obligations
  • Health-oversight activities
  • Other legally authorized government functions

HIPAA does not provide law enforcement unrestricted access to a patient's medical record.

An appropriate legal basis must exist for a disclosure.

Lawsuits & Legal Proceedings

Protected health information may be disclosed in connection with judicial or administrative proceedings when permitted or required by law.

Depending on the situation, an appropriate basis may include:

  • Patient authorization
  • Court order
  • Administrative order
  • Subpoena satisfying applicable legal requirements
  • Other legally sufficient process

Additional protections may apply to certain categories of information.

Auto Accident & Personal Injury Matters

When you receive treatment related to an auto accident or personal injury matter, Summit may communicate with authorized parties when permitted by law.

Depending on your circumstances, this may include:

  • Your attorney
  • Insurance companies
  • Claims representatives
  • Imaging facilities
  • Other healthcare providers
  • Other persons or organizations you authorize

When authorization is required, Summit will obtain the appropriate authorization before disclosing protected health information.

The existence of a personal-injury or attorney matter does not eliminate your privacy rights.

Medical Examiners, Coroners & Funeral Directors

We may disclose health information to a coroner, medical examiner, or funeral director when authorized by law and appropriate under the circumstances.

Organ & Tissue Donation

When applicable, health information may be disclosed to organizations involved in organ, eye, or tissue donation and transplantation as permitted by law.

Substance Use Disorder Patient Records

Federal law provides additional protections for certain substance use disorder patient records subject to 42 CFR Part 2.

To the extent Summit creates, receives, or maintains records that are subject to Part 2, those records will receive the protections required by applicable law.

Part 2-protected information generally may not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against a patient unless applicable legal requirements are satisfied, which may include the patient's written consent or an appropriate court order and subpoena.

If Part 2 information is proposed to be used for fundraising communications, Summit will provide the advance notice and choice required by applicable law.

Minors, Parents & Guardians

Privacy rights involving minors may depend on:

  • The patient's age
  • Who consented to treatment
  • Texas law
  • Federal law
  • The nature of the healthcare
  • Other legal circumstances

Parents or legal guardians generally may exercise rights concerning a minor's health information when permitted by law.

There are circumstances where the law may limit access.

Summit will follow applicable federal and Texas law when determining who may access a minor patient's health information.

Uses or Disclosures Requiring Authorization

Uses or disclosures that are not otherwise permitted or required by law generally require appropriate authorization.

When authorization is required, you may generally revoke it in writing.

Revocation does not undo disclosures or other actions Summit already took in reasonable reliance on a valid authorization before receiving the revocation.

Our Responsibilities

Summit Spine & Wellness is required to:

  • Maintain the privacy of protected health information as required by law
  • Maintain reasonable administrative, physical, and technical safeguards
